"our", "us") is committed to protecting your privacy and safeguarding your personal data in accordance with UAE Federal Decree-Law No. 45 of 2021 on the Protection of Personal Data ("UAE PDPL") and, where applicable, the EU General Data Protection Regulation ("GDPR") and all other applicable data protection laws. This Privacy Policy sets out the basis on which any personal data we collect from you, or that you provide to us, shall be processed by us.
This Privacy Policy applies to all individuals whose personal data we process, including visitors to our website, subdomains, web applications, and landing pages at www.finanshels.com ("Site"), users of our client portal at htts://app.finanshels.com ("Finanshels App" or "FinOS" or "PMS"), users of our partner portal at https://partner.finanshels.com or https://collab.finanshelscom (Partner Portal), users of our reporting platform at https://reports.finanshels.com ("FinDelivery"), or Taxation Platform or Halatax at https://halatax.finanshels.com ("Halatax") prospective clients who interact with us through our enquiry forms, tools, appointment booking system, or other channels, existing or former clients who have engaged Finanshels for professional services, and individuals whose personal data is submitted to us by a referral partner through the Partner Portal. By accessing or using our Site, the Portal, the Partner Portal, FinDelivery, Halatax or ourServices, you acknowledge that you have read, understood, and agree to the terms of this Privacy Policy. If you do not agree, you must not use our Site, the Portal, the Partner Portal, FinDelivery, Halatax or our Services.
We collect and process the following categories of personal data depending on how you interact with us.
1.1 Identity and Contact Data
Your name, email address, postal address, telephone number, and WhatsApp contact details, together with demographic information such as date of birth, gender, and nationality where relevant to the services provided.
1.2 Business and Financial Data
Your company name, industry, size, job title, trade licence, tax registration details, financial statements, bank account details, payroll records, and such other financial and business information as is necessary for the delivery of our professional services.
1.3 Compliance and Verification Data
Identity and verification documents including Emirates ID, passport copies, visa documentation, ultimate beneficial owner information, and source of funds documentation, collected in fulfilment of our obligations as a Designated Non-Financial Business and Profession (DNFBP) under UAE anti-money laundering legislation.
1.4 Technical and Usage Data
Your IP address, browser type, operating system, referral source, pages visited, dates and times of access, device identifiers, and information collected through cookies and similar tracking technologies when you visit our Site or use our Portals.
1.5 Communication and Engagement Data
Records of all communications with us through any channel, including email, telephone, WhatsApp, enquiry forms, appointment bookings, and portal messages. This includes information recorded in our systems in connection with your enquiry, sales engagement, or professional services engagement.
1.6 Tool and Assessment Data
Information you provide when using tools or calculators available on our Site, which may include business financial figures, tax registration details, and operational data. Such information is used solely to generate the requested output and to improve our services.
We collect personal data through the following methods.
2.1 Direct Interactions
We collect personal data directly from you when you submit an enquiry through our Site, register for or access the Portal, book an appointment, request information or professional services, or contact us through any channel including email, telephone, or WhatsApp.
2.2 Automated Technologies
As you navigate our Site or use our Portal, we automatically collect certain technical and usage data through cookies, analytics tools, and similar technologies. Further details are set out in our Cookie Policy.
2.3 Third Parties and Referral Partners
We may receive personal data from third-party service providers including analytics, marketing, and CRM providers, from publicly available sources such as business directories and company registers, and from referral partners or existing clients who introduce you to us, including through our Partner Portal. Where personal data is submitted to us by a referral partner, we process such data in accordance with this Privacy Policy for the purpose of evaluating and administering the relevant referral or engagement.
We shall process your personal data only where we have a lawful basis to do so. The legal bases upon which we rely vare: performance of a contract or steps taken at your request prior to entering into a contract; compliance with a legal obligation to which we are subject; your consent where expressly obtained; and our legitimate interests where not overridden by your rights and interests. We use your personal data for the following purposes.
3.1 Service Delivery
To deliver and manage our accounting, bookkeeping, tax compliance, payroll, AML compliance support, CFO advisory, and related professional services, to manage your Portal account and process documents, and to conduct customer due diligence, identity verification, and ongoing monitoring as required by UAE anti-money laundering legislation.
3.2 Communication
To send administrative communications, including changes to our terms, policies, and service arrangements, and to send promotional materials, newsletters, and service updates where you have consented to receive them or where we have a legitimate interest in doing so. You may withdraw consent or opt out at any time by contacting us at contact@finanshels.com.
3.3 Improvement and Analytics
To analyse usage patterns and improve our Site, Portal, and services, to develop new products and service offerings, and to conduct internal research and business development, including through the use of artificial intelligence and automated technology tools in accordance with the provisions of this Policy.
3.4 Legal and Regulatory Compliance
To comply with all applicable legal and regulatory obligations including UAE anti-money laundering and tax laws, to enforce our Terms and Conditions, to protect the rights, property, and safety of Finanshels and our clients, and to report to regulatory authorities where required by law including the UAE Financial Intelligence Unit in our capacity as a DNFBP.
We may share your personal data in the following circumstances.
4.1 Within Our Corporate Group
We may share your personal data with our subsidiaries and affiliates for operational, administrative, and service delivery purposes, subject always to this Privacy Policy.
4.2 With Service Providers
We may share your personal data with third-party service providers who perform functions on our behalf, including cloud hosting and infrastructure providers, CRM and sales automation platforms, email and communication tools, productivity and collaboration platforms, analytics providers, advertising platforms, payment processors, accounting software providers, artificial intelligence and automated technology service providers as further described in Section 10, and technology tools used in service delivery. All such providers are contractually required to process your personal data only on our instructions and to maintain appropriate data protection standards.
4.3 For Legal and Regulatory Purposes
We may disclose your personal data where required by applicable law, court order, or regulatory authority, or to protect the rights, property, or safety of Finanshels, our clients, or others. In our capacity as a DNFBP, we may be required to disclose information to the UAE Financial Intelligence Unit or other regulatory authorities without your knowledge or consent. We are legally prohibited from informing you of any such disclosure where doing so would constitute a tipping-off offence under UAE anti-money laundering law, and you agree that Finanshels shall incur no liability to you in connection with any such report or disclosure.
4.4 Business Transfers
In connection with any merger, acquisition, restructuring, or sale of assets, your personal data may be disclosed to the actual or prospective acquirer and their advisers, subject to appropriate confidentiality obligations.
4.5 Payment Data
All credit and debit card details and personally identifiable payment information shall not be stored, sold, shared, rented, or leased to any third parties. Where payments are processed through third-party payment platforms, such processing is governed by those platforms' own terms and privacy policies, and Finanshels shall not pass card details to any third party save as is strictly necessary to process your payment.
Finanshels operates across multiple jurisdictions and your personal data may be transferred to and processed in countries outside your jurisdiction, including but not limited to the United Arab Emirates, the United States of America, and India. Such countries may not provide the same level of data protection as your home jurisdiction.
Where we transfer personal data internationally, we shall ensure that appropriate safeguards are in place to protect your data, including Standard Contractual Clauses approved by relevant regulatory authorities, data processing agreements with receiving parties, and such other transfer mechanisms as are required under applicable law. We shall ensure that all service providers receiving your personal data comply with applicable data protection laws.
Finanshels employs industry-standard technical and organisational measures to protect your personal data against unauthorised access, alteration, disclosure, loss, or destruction. Our security measures include encryption of data in transit and at rest, access controls restricting unauthorised personnel from handling sensitive information, regular security reviews, and data protection training for our team.
Notwithstanding the foregoing, no method of transmission over the internet or electronic storage is entirely secure. Whilst we take our security obligations seriously, we cannot guarantee absolute security. We shall retain your personal data only for so long as is necessary to fulfil the purposes for which it was collected, or as required or permitted by applicable law. The following minimum retention periods apply: client financial and accounting records shall be retained for 7 (seven) years from the end of the relevant financial year, as required by UAE Corporate Tax Law; AML and KYC records shall be retained for 5 (five) years from the end of the business relationship, as required by UAE anti-money laundering legislation; active client records shall be retained for the duration of the engagement plus 5 (five) years; prospective client and lead data shall be retained for 24 (twenty-four) months from the date of last meaningful interaction, unless marketing consent is withdrawn earlier; Portal account data shall be retained for 30 (thirty) days following termination of your engagement, after which it shall be deleted or anonymised subject to any longer retention required by law; website analytics data shall be retained for 14 (fourteen) months on a rolling basis; and marketing communication records shall be retained until opt-out is received, plus (12) twelve months for suppression purposes.
Upon expiry of the applicable retention period, personal data shall be securely deleted or anonymised such that itcan no longer be attributed to an identified or identifiable individual.
To exercise any of the above rights, please submit a written request to us at contact@finanshels.com. We shall respond to all valid requests within thirty calendar days of receipt. We may request proof of your identity before processing your request. Please note that certain rights are subject to limitations under applicable law, including where retention is required to fulfil legal obligations arising under UAE anti-money laundering legislation, in which case the right to erasure shall not apply.9. Cookies and Tracking Technologies
Subject to applicable law and certain exceptions, you have the following rights in relation to your personal data: the right to request access to and a copy of the personal data we hold about you; the right to request correction of inaccurate or incomplete personal data; the right to request deletion of your personal data where there is no compelling reason for its continued processing; the right to request restriction of processing in certain circumstances; the right to receive your personal data in a structured, commonly used, and machine-readable format; the right to object to our processing of your personal data including for direct marketing purposes; and the right to withdraw consent at any time where processing is based on your consent, without affecting the lawfulness of processing carried out prior to withdrawal.
We use cookies and similar tracking technologies on our Site to improve Website functionality and security, analyse Website traffic and user interactions, and personalise user experiences. Data Transfers and International Processing
Finanshels employs artificial intelligence and automated technology tools across its operations, including in the delivery of professional services, marketing activities, and internal business functions. By engaging with us or using our Services, you consent to your personal data being processed through such tools, including where such processing is carried out by service providers located outside the United Arab Emirates, subject to the safeguards set out in Section 5 (International Data Transfers) of this Policy. We do not sell your personal data, and we do not use it to train publicly available or third-party AI models. All technology tools deployed by Finanshels that process personal
data are subject to appropriate data protection and confidentiality agreements.
Our Site and Services are not directed at or intended for use by individuals under the age of 18 (eighteen) years. We do not knowingly collect personal data from minors. If you believe that a minor has provided us with personal information without appropriate consent, please contact us at contact@finanshels.com and we shall take prompt steps to delete such information from our records.12. Data Retention Policy
Our Site may contain links to third-party websites or services. Finanshels is not responsible for the privacy practices, policies, or content of such third-party sites and accepts no liability in connection therewith. We encourage you to review the privacy policies of any external sites before providing any personal information to them.13. Third-Party Services & External Links
Finanshels reserves the right to update or amend this Privacy Policy from time to time to reflect changes in our practices, legal obligations, or regulatory requirements. Where changes are material, we shall notify you by email or by posting a prominent notice on our Site prior to the change becoming effective, and shall update the effective date accordingly. Your continued use of our Site and Services following notification of any changes shall constitute your acceptance of the updated Privacy Policy.
By using our Site and Services, you confirm that you have read and understood this Privacy Policy, that you agree to the collection, processing, and protection of your personal data as described herein, and that you consent to international data transfers as set out in this Policy.
This Privacy Policy shall be governed by and construed in accordance with the laws of the United Arab Emirates. Any dispute arising out of or in connection with this Privacy Policy shall be subject to the exclusive jurisdiction of the Courts of Dubai, UAE.
