An FTA VAT audit in the UAE has no fixed legal duration — but every milestone around it does. The Federal Tax Authority must give you at least 10 business days' notice before the audit starts, must notify you of the results within 10 business days of the audit ending, and must base any correction on records no older than the look-back window — generally 5 years from the end of each tax period, or 15 years where tax evasion is suspected. Whether the audit itself takes two weeks or six months depends on its scope (a desk review versus an on-site field audit) and, above all, on how quickly and completely you can produce the records the auditor asks for. This guide sets out every legally fixed deadline, what actually stretches the audit, and the penalty rules that turn a slow audit into an expensive one.
The deadlines the law fixes around a VAT audit
The Tax Procedures framework (Federal Decree-Law No. 28 of 2022 and its Executive Regulation, Cabinet Decision No. 74 of 2023) governs audits of VAT registrants the same way it governs corporate tax audits. Four time rules are fixed:
- Notice before the audit. The FTA must notify you of a tax audit at least 10 business days before conducting it, and the notice must set out the possible consequences of obstructing the auditor (Federal Decree-Law No. 28 of 2022, Art. 16, as consolidated by the Ministry of Finance in December 2025).
- Where it happens. The FTA may perform the audit at its own premises or at the place of business of the person audited (Tax Procedures Decree-Law, Art. 16).
- Results of the audit. The FTA must notify you of the audit's results within 10 business days from the end of the audit (Cabinet Decision No. 74 of 2023, Art. 19).
- Access to the working papers. After the results, you may request the documents, data and information the FTA based its assessment of due tax on, within 20 business days of being notified of the results (Cabinet Decision No. 74 of 2023, Art. 19).
Everything between "audit starts" and "audit ends" is not fixed in the law — it is fixed by the auditor's scope and your response time.
What actually decides how long the audit takes
Two audits of the same-sized business can differ by months, for reasons that are all yours to control:
- Desk review versus field audit. A desk review of filed returns can conclude inside the notice-and-results windows. A field audit at your premises extends by the days the auditor spends on site and the days your team takes to retrieve records.
- Document requests. During the audit the FTA can request records, commercial books and any other data and information (Cabinet Decision No. 74 of 2023). Each request you answer slowly extends the audit day-for-day.
- Arabic-language records. If the FTA requests records in Arabic and you cannot provide them, that is a violation in its own right — the penalty for failing to submit requested records in Arabic was reduced to AED 5,000 by Cabinet Decision No. 129 of 2025, effective 14 April 2026 (FTA news, 15 April 2026).
- Facilitation duties. A person subject to audit must facilitate the tax auditor; failing to do so is a penalised violation under the administrative penalties decision (Cabinet Decision No. 40 of 2017 and its amendments).
The look-back window: how far back the FTA can audit
| Scenario | How far back the FTA can audit or assess | Source |
|---|---|---|
| Standard case | Up to 5 years from the end of the relevant Tax Period | Decree-Law 28/2022, Art. 16 (limitations) |
| Audit notified before the 5 years expire | The audit must be completed or assessed within 4 years of the audit notification | FTA Public Clarification VATP030 |
| Voluntary disclosure filed in the fifth year | Audit/assessment completed within 1 year of the disclosure | Decree-Law 28/2022 |
| Suspected tax evasion | Up to 15 years from the end of the Tax Period in which evasion occurred | Decree-Law 28/2022, Art. 16 |
| Failure to register | Up to 15 years from the date you should have registered | Decree-Law 28/2022, Art. 16 |
This is why record-keeping discipline outlasts the year the records were made: you must retain accounting records, tax invoices and credit notes for the retention window — five years as a baseline under the Tax Procedures framework, and longer while an audit is open or for real-estate records (Cabinet Decision No. 74 of 2023, Arts. 12 and 20; the VAT Executive Regulation's real-estate rule).
After the audit results: your two challenge routes
If the audit ends in a Tax Assessment you disagree with, two routes exist and each has its own clock:
- Reconsideration request to the FTA under Article 27 of the Tax Procedures Decree-Law — the FTA may extend the deadline for deciding on a formally valid request by 20 business days (Cabinet Decision No. 74 of 2023, Art. 25).
- Objection to the Tax Disputes Resolution Committee — an objection must be submitted within 40 business days of being notified of the FTA's decision on a reconsideration request, and the Committee decides within 20 business days, extendable by 60 (Tax Procedures Decree-Law, Arts. 32–33).
FAQ
How long does an FTA VAT audit take from notice to results?
The law fixes notice at 10 business days before the audit and the results notification at 10 business days after it ends (Tax Procedures Decree-Law, Art. 16; Cabinet Decision 74/2023, Art. 19). The audit itself has no statutory duration: a desk review can close inside those windows, while a field audit with slow document responses can run for months.
How far back can the FTA audit my VAT returns?
Generally five years from the end of each tax period — 15 years where tax evasion or failure to register is involved (Tax Procedures Decree-Law, Art. 16). If the audit was notified before the five years expired, it must be completed within four years of that notification (FTA Public Clarification VATP030).
What happens if I cannot produce the requested records in time?
Slow responses extend the audit, and failing to provide requested records — including in Arabic when requested — is a penalised violation, with the Arabic-records penalty set at AED 5,000 from 14 April 2026 (Cabinet Decision 129/2025). Facilitation of the auditor is itself a legal duty.
Can I challenge the audit's outcome?
Yes: a reconsideration request to the FTA, then an objection to the Tax Disputes Resolution Committee within 40 business days of the FTA's reconsideration decision (Tax Procedures Decree-Law, Arts. 27 and 32).
